1. Acceptance

By using this website you agree to these Terms of Use. If you do not agree, please do not use the site.

2. What this website is

This website is the brand site for the Makhe mobile application. It is for information purposes. The Makhe app, when launched, will have its own separate Terms of Service that govern your use of the app. Certain features on the Makhe platform use third-party payment and escrow services, which are described in sections 3 and 4 below.

3. Payment processing — PayFast

Payments on the Makhe platform are processed by PayFast (Pty) Ltd (registration number 1999/017441/07, trading as Payfast by Network), an independent payment service provider. Makhe does not store, process, or have access to your card or banking credentials — all payment data is handled directly by PayFast in accordance with PCI-DSS standards.

Before transacting, you are encouraged to review PayFast's Privacy Policy and PayFast's Terms and Conditions, which govern the processing of your payment.

Refunds. Where a refund is authorised by Makhe, it will be processed back to your original payment method via PayFast. Refund timelines are subject to PayFast's processing schedule and your card issuer.

Chargebacks. If you have a concern about a payment, please contact us at info@makhe.co.za before initiating a chargeback with your bank or card issuer. Raising a dispute with us first allows us to resolve the matter quickly and preserves your chargeback rights if the dispute cannot be resolved.

Limitation of liability. Makhe is not liable for any failure, delay, error, or unavailability of the PayFast payment platform. Any claims relating to payment processing should be directed to PayFast in accordance with their terms.

4. Escrow services — TradeSafe

Certain transactions on the Makhe platform are secured through TradeSafe Token (Pty) Ltd, a PASA-authorised digital escrow provider operating under Standard Bank oversight and insured by iTOO.

How escrow works. When an escrow transaction is initiated, the following steps apply:

  1. Funds deposited. The buyer deposits funds into TradeSafe's escrow account. The funds leave the buyer's account but are not yet released to the seller.
  2. Funds held. TradeSafe holds the funds securely during the 24-hour inspection window.
  3. Buyer confirms. Once the buyer is satisfied with the goods or services received, they confirm delivery within the 24-hour inspection window.
  4. Funds released. TradeSafe releases the funds to the seller. If the buyer takes no action within the 24-hour inspection window, funds are automatically released to the seller.

Fees. TradeSafe charges an escrow fee that accrues upon receipt of funds into escrow, regardless of the outcome of the transaction. The applicable fee and its allocation (buyer, seller, or split) will be disclosed to you before you commit to an escrow transaction.

Disputes. Disputes regarding an escrow transaction must be raised within the 24-hour inspection window using TradeSafe's dispute process. Makhe does not adjudicate escrow disputes — resolution is handled by TradeSafe in accordance with their terms.

Account requirement. To use TradeSafe escrow, you must hold a TradeSafe account, provide a valid South African identity number, and have a South African bank account for disbursements.

Limitation of liability. Makhe is not liable for any failure, delay, error, or unavailability of the TradeSafe escrow platform. Any claims relating to escrow services should be directed to TradeSafe in accordance with their terms.

5. Third-party services — general

The Makhe platform integrates third-party services, including but not limited to those described in sections 3 and 4 above. Each third-party service is governed by its own terms and conditions, privacy policy, and operating rules. Makhe is not responsible for the availability, conduct, or performance of any third-party service. You should review the terms of any third-party service before using a feature powered by that service.

6. Permitted use

You may browse this site, join the early access list, and send us a message. You may not scrape it, attempt to breach its security, misrepresent yourself on our forms, or use it in any way that violates South African law.

7. Intellectual property

The Makhe name, logo, wordmark, and the content of this site are the intellectual property of Makhe (Pty) Ltd. You may link to this site freely. You may not reuse its content without written permission.

8. No warranty

This site is provided as is. We do our best to keep it accurate and available, but we do not warrant it will always be. Information on this site about the forthcoming app is our intention at the time of publication — feature set, launch date, and pricing may evolve.

9. Limitation of liability

To the extent permitted by South African law, Makhe will not be liable for indirect or consequential loss arising from use of this website. In particular, Makhe's liability does not extend to any failure, delay, or error by PayFast, TradeSafe, or any other third-party service provider integrated into the Makhe platform.

10. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be settled in the courts of South Africa.
